Terms Of Use

The Whiteboard

The terms and conditions set forth apply to the candidate who has enrolled to a training course (hereinafter referred to as “Candidate” or “You” / “Your”) in connection with the use of the training facilities at the classrooms or on the websites or other platforms owned by or rented by The Whiteboard. (hereinafter referred to as the “Company” or “We” / “Our” / “Us”). Your use of any of the training facilities shall be construed as your acceptance to be bound by the terms and conditions set forth. By signing this document, you provide your irrevocable consent and acceptance to the terms and conditions set forth in this document. Company’s acceptance will be expressly conditioned upon your assent to all the terms and conditions of this document.

USE OF TRAINING FACILITY AND ITS EQUIPMENT:

  1. If the training is conducted at a Company facility, all computers will be provided for practical training and to perform project/assignment work during the designated time-periods only. If Company has permitted you to undergo this training remotely, you will arrange appropriate computer and equipment at your own cost.
  2. A system administrator would establish user profile for each enrolled Candida te and will generate a unique username and password on assigned systems to each Candidate. This username and password would be authorized to log on to computer systems provided by the company.
  3. Once the training and project/assignment work is completed, system administra tor will disable this user profile after which user will not be able to log on or delete an y the data from the profile. After completion of training and internship/assignments, user will not have any right to access any systems.
  4. Computers associated with training and internship are configured to disable the USB port, Internet connection and CD drives for data security and to minimize malware risk. Candidates may get access of shared drives to receive and send the training and project related work.
  5. After the completion of course, candidate will not be eligible to access the training facilities without written permission from the company.

USE OF VIRTUAL CLASSROOM:

  1. Use your full name when you sign into the classroom and you must have good internet connection. Choose a quiet space, free from distractions, to set yourself up for class. Turn off cell phones, TVs, etc. Exit other applications on your computer prior to entering the classroom. Students Dress appropriately. Remember this is still a classroom setting.
  2. When you enter the classroom, make sure to enable both audio and video. You must mute your microphone during the lesson to avoid disturbing the class with any background noise.
  3. Participate. When you have a question or comment, use the “Raise your Hand” button that can be found in the window that pops up when you click on Participants in the bottom menu. Wait to be acknowledged by the trainer before unmuting yourself to speak.
  4. Use the chat responsibly. It is meant to facilitate conversation around the lesson topic, do not side-line discussions.
  5. When your class is over, leave the classroom by closing the window

CODE OF CONDUCT

  1. You are allowed to access our training facilities and content only for lawful purposes. You are yourself responsible for knowing and complying with all laws, rules and regulations that may apply to your use of the training facilities and content. You agree that you shall not use the products or other content in any form to hire, solicit or influence our trainers, administrators or potential users for employment or contracting for any business not affiliated to the company.
  2. Consumption of Food and beverages is not allowed inside the class rooms/ Online sessions. Moreover, smoking, chewing of tobacco & bubble gums, consumption of alcohol is strictly prohibited inside the company premises.
  3. Official working hours will be 9:00 am to 6:00 pm Monday to Friday IST as per the days allotted to the respective batch. For weekend batches the working hours will be 9:00 am to 6:00 pm Saturday and Sunday IST. Candidates may be asked to attend a few training sessions beyond these scheduled hours as per the mutual convenience and availability. Such timings will be communicated to the Candidates in advance.
  4. Every candidate is expected to be dressed in a decent manner and maintain decorum.
  5. Every candidate should wear the ID card provided by the company at all times when on the company premises. Candidates are required to register their entry and exit either by making an entry in the register kept with the security or swiping their electronic access cards as the case may be.
  6. The ID card issued to the Candidate is company’s property and must be returned on being notified by the company to do so. The candidate will be liable and accountable for any misuse of the lost or stolen ID card until such loss is reported in writing to the company. If a candidate loses his/her ID card, he/she will be given a replacement ID card on payment of a fee of Rs 250/- (Two Hundred and Fifty only).
  7. If any Candidate is found misusing the ID card (the misuse includes but is not limited to tailgating, sharing ID cards with other candidates etc), his/her enrolment may be cancelled immediately without any refund.
  8. Use of any external memory devices or electronic equipment such as CD, DVD, USB drive, Floppy Disk, I pod, personal laptops is strictly prohibited inside the company facilities.
  9. Security personnel can perform random check of all belongings carried by the Candidates at any time and without prior notice. Candidates are required to always cooperate with security personnel during the security checks. This is necessary to ensure safety, security and well-being of company property, employees and Candidates. In case of policy violation, Company will be authorized to take necessary steps or actions against respective individual.
  10. In case of any damage to the company property knowingly or unknowingly caused by the Candidate, he/she will liable to compensate the company for such damage or pay for it.
  11. The Candidates are required to sign the Non-Disclosure Agreement with the Company and make sure that he/she adheres to the clauses described in the agreement.
  12. The company is committed to maintaining a safe and healthy environment for all faculty, staff and students, and will not tolerate any form of violence or abusive behaviour. Violence and abusive behaviour include but are not limited to any attempted, threatened, or actual conduct that endangers or is likely to endanger the health or safety of a training community member or visitor, or any threatening statement, harassment, or behaviour that gives a training community member or visitor reasonable cause to believe that his or her health or safety is at risk. Accidents are not considered workplace violence or abusive behaviour even though safety or property may be at risk or harmed. Candidate accepts that Company has a right to enforce reasonable discipline and counselling protocol. The candidate(s) who engage in actions or threats of violence or abusive behaviour will be subject to the appropriate disciplinary action including termination.
  13. The candidate shall take all necessary precautions to safeguard his/her personal belongings brought in the training facilities. The company will not be responsible for loss, theft or damage to such personal belongings.

FEES & STANDARD INSTALLMENT POLICY

  1. Company representative will be communicating fees and payment schedules for respective programs via email or in a physical form during counselling on the basis of request given by prospective candidates.
  2. Registration will be confirmed only upon payment of the stipulated amount as per the payment scheduled communicated by the company representative.
  3. If at any point of time, the applicable taxes change, the candidate will be liable to make additional payments as necessary.
  4. By providing credit/debit card information, you represent and warrant that you have necessary authorization to present such information and you authorize the company to charge your credit / debit card to pay the fees as and when they are due.
  5. If the candidate fails to pay any of the agreed instalments, then the company reserves the right to deny the candidate’s entry into the classrooms or the computer labs until the outstanding amount is paid along with the penalty as applicable.
  6. Seasonal discounts may be available from time to time at Company’s discretion. At the time of registration, the company representative will inform and provide an update on prevailing offer (if any) to the candidates. The company representative will process the admission only after the candidate provides his/her consent in writing to the pricing details. In case of different offers available at the same time, candidates will be allowed to avail of one offer only.
  7. Candidates opting to pay the fee in instalments shall abide by the following additional rules:
  1. The installment pattern for every course is fixed, both in terms of schedule and amount. Installment pattern will not be changed (or transferred) once it is agreed upon by the candidate.
  2. As a part of installment policy, candidate will be liable to submit PDCs (Post Dated Cheques) at the time of registration as per the installment dates along with all necessary documents requested by company representative before commencement of the batch. Without this step, the registration will always be considered as incomplete and Candidate will not be permitted to attend on the batch start date.
  3. It is the responsibility of the candidate to ensure that sufficient balance is maintained in the corresponding bank account on installment date. In case the cheque gets dishonored, the company will be eligible to pursue any legal remedy at its discretion, and additionally the candidate will be required to pay bank charges (as applicable from time to time) along with installment amount immediately.
  4. In case the candidate wishes to change the mode of payment for any installment, he/she must inform the respective company representative minimum 5 working days ahead of the date of encashment in writing. In case the candidate fails to inform the counselor in advance and if such cheque gets dishonored by the bank, the candidate will be required to pay bank charges (as applicable from time to time) along with installment amount immediately.
  5. If the candidate fails to pay two of the installments for any reason whatsoever, then the company will be authorized to suspend the enrolment of the candidate until the entire outstanding amount, including that for the future installments along with the penalty for failed transactions, if any, is paid by the candidate in a single transaction. The candidate will be responsible for the loss of learning during the time of suspension for the reason stated in this clause. Company will not allow any compensatory classroom attendance for such loss of learning.

CONTENT, LICENSES & PERMISSIONS

  1. For the purpose of this agreement, the term “Content” shall mean all information, communications, text, graphics, designs, materials, electronic art, animations, illustrations, artwork, audio clips, video clips, photos, images, reviews, ideas, website links, and other data or copyrightable materials and software technology or the selection and arrangements thereof. The Content shall always remain the proprietary property of the Company or the owner who has granted the Company the right to use this content and is protected, without limitation, pursuant to Indian, U.S. and foreign copyright and other intellectual property laws. The Company hereby grants the candidate (as a User) a limited, non-exclusive, non- transferable license to access and use the Company’s content, for which the candidate has paid all required fees, solely for candidate’s personal, non- commercial, educational purposes through company’s training facilities in accordance with these Terms and any conditions or restrictions associated with particular Courses or Products. Candidate is not allowed to reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, license, or otherwise transfer or use any Submitted Content or Company’s content unless candidate has a written permission from the company for doing so. The Company’s content is licensed, and not sold, to candidate at any time.
  2. Candidate acknowledges and agrees that the company may record all or any part of any Courses (including voice chat communications) for quality control and delivering, marketing, promoting, demonstrating or operating the Site and the Products. Candidate hereby grants the Company consent to use candidate’s name, likeness, image or voice in connection with offering, delivering, marketing, promoting, demonstrating, and selling the Site, Products, Courses, Company’s content and Submitted Content and you waive any and all rights of privacy, publicity, or any other rights of a similar nature in connection therewith, to the extent permissible under applicable law. The company respects all copyright, privacy and other laws, rules and regulations relating to the content and information. The company will not tolerate violation of such laws. The rights which are not expressly granted are retained by the Content owners or the company and there is no intention to grant any implied licenses to the users.

SCOPE OF SERVICE

  1. In exchange of the fee, the company is liable to offer the following services to the candidates:
  1. Provide classroom/ Online training relevant for the course as per the schedule shared with the candidate from time to time.
  2. Provide printed course material applicable for the course.
  3. Provide access to computer labs for practical assignments during the course tenure.
  4. Provide feedback on the assignments / answer sheets submitted by the candidate as part of the assessment during the course.
  5. Provide opportunity to interact with subject matter experts in the respective fields as per the schedule published from time to time.
  1. The company’s obligation towards a candidate will be treated as completed when a) the candidate has fulfilled all requirements towards the completion of the course and has been issued a completion certificate or b) after the end date of the training batch to which the candidate had enrolled, or c) if the candidate exits the enrolled program prematurely for any reason whatsoever, whichever is earlier.
  2. When candidate enrols for a course, it is candidate’s responsibility to complete the course within the time limit defined for the particular batch to which candidate is assigned. The duration of the batch will be conveyed at the time of enrolling to the course. If candidate fails to complete the course within the prescribed time limit, the company may terminate the enrolment and prevent the candidate from accessing company’s training facilities beyond the end date of the course conveyed at the time of enrolment. No refund, in part or in full shall be payable in such cases.
  3. Company is not obliged to provide any parking facility. Making arrangements for lawful parking of vehicles, if needed, is the candidate’s responsibility.
  4. Company is not obliged to provide beverages or snacks to the candidates. However, the company may, at its sole discretion, pay for the tea and/or snacks served by an external vendor to the candidates. The company takes no responsibility for the hygiene, nutritional value, freshness or compatibility to any allergic condition of the food and beverages being served and the candidates are advised to apply their own discretion about consuming the food and beverages being served.

CANCELLATION

  1. The cancellation of enrolment will be handled differently as per the applicable case:
  1. Cancellation by the Company: The company reserves the right to cancel a Training Course at any time. If the company cancels a Training Course for which the candidate is registered as a Registered User, the same will be notified to candidates through email and/or phone, at the address and/or telephone number provided on the Registration form, and candidate will have the option to receive a refund of the Training Course registration fee or a voucher to attend any future Training Course (provided such voucher is used within one (1) year from the date of issuance). Candidate will be entitled to opt for any of the above-mentioned options within 15 days from the date of notification by the company failing which candidate will lose the right to claim the refund or voucher.
  2. Cancellation by Candidate: If candidate wishes to cancel registration for a Training Course candidate must communicate to the company in writing. Candidate will not be entitled for any refund in such case.
  3. Force Majeure: Neither party shall be liable for lack of availability of Services, delay in performance or failure to perform, in whole or in part, the terms of this document due to strike, labour dispute, act of war, labour shortage, telecommunications failures, equipment or software failures, riot or civil commotion, act of public enemy, fire, flood or act of government or God or other cause beyond the control of such party. In particular, the operation of the Services may be interrupted due to maintenance, updates, or system or network failures. The company disclaims all liability for damages caused by any such interruption or errors in functioning. Furthermore, the company disclaims all liability for any malfunctioning, impossibility of access, or poor use conditions of the company facilities due to inappropriate equipment, disturbances related to Internet service providers, to the saturation of the Internet network, and for any other reason.
  4. Non-usage of service by Candidate: If candidate remains absent from the training classes or other academic activities for a duration of 30 (thirty) or more calendar days at a stretch, the company reserves the right to cancel the enrolment and no liability shall befall the company to refund the fees already paid, either in full or in part.

REFUND

  1. The company offers no refunds for any fee paid towards a training course except as mentioned in the clause “Cancellation by the Company” above.

ACADEMIC REQUIREMENTS

  1. The course timings will be communicated well in advance and the candidate will be required to follow the same. For extra practice hours the candidate shall be required to seek prior permission from the trainers or batch coordinators. The company may provide the requested additional access at its sole discretion based on availability and feasibility.
  2. The company will have full rights to make changes in training, internship and practice timings as and when required and such changes will be communicated to the candidates ahead of time.
  3. Candidates are required to finish their respective work (which includes projects, case studies, submission, assignments etc.) within the time window allotted for each training module. All requests for access to the training or internship facilities beyond the duration of the respective module should be authorized by the company subject to the availability of classrooms and/or workstations.
  4. The candidates are advised to attend all training sessions as per the schedule. If any candidate skips the training and projects sessions, no extra make up session will be provided. Internship: All project work should be finished within given timeline. For any project related queries, the candidate is advised to approach batch coordinator(s). The completion certificate may not be issued if the candidate fails to complete the project(s) within given timeline. The company will not responsible for any loss in such circumstances.
  5. Attendance should be above 80% throughout the program.
  6. The Certificate of Completion of a training course will be issued provided all of the following conditions have been fulfilled –
  1. The candidate has cleared all the assessment units (tests, quizzes, assignments, case studies etc) as prescribed for the course.
  2. The candidate has fulfilled the requirements towards completion of the project(s) as applicable for the course.
  3. The candidate has returned the Company Property in his/her possession and has cleared all the dues owed by him/her to the company.
  4. The candidate has completed all the formalities and submitted the necessary documents as part of the enrolment process.
  5. All other conditions defined for the specific course have been fulfilled by the candidate, as may be conveyed by the company from time to time.

PLACEMENT ASSISTANCE

  1. The Whiteboard do not promise any job guarantee. The job opportunities depends upon the market and industry dynamics.
  2. The candidate understands that the company’s role is to spot the recruitment opportunities in the market, help the candidate apply for the same and provide him/her assistance for preparing towards the recruitment process. The candidate further understands that, as with any job opportunity the end result will vary and be based on individual’s personal abilities, experience, knowledge, capabilities, level of desire, and a number of variables beyond the company’s control, including situations that cannot be anticipated. The company assumes no assurance of placing the candidate or taking him/her to a certain income level. The candidate agrees to provide all necessary documents to establish his/her educational qualification, professional experience or extra-curricular abilities as stated in your resume. The candidate also agrees to take full accountability for the truthfulness and accuracy of the academic / professional / extra-curricular records, certificates etc. being submitted to the company while creating a placement profile.
  3. The candidate agrees that placement assistance will be provided only on fulfillment of the two conditions: a. The candidate is consistently adhering to the on-time completion of various requirements of the course b. The candidate has paid all fees and cleared all liabilities, if any, towards the Company

MISCELLANEOUS

  1. The violation of any of the terms and conditions by the candidate shall be adequate grounds for cancellation of the enrollment, and no liability shall befall the company to refund the fees already paid, either in full or in part.
  2. In case of a situation which is not covered by the policies described in this document, the company’s decision will be final and binding on the candidate.
